After careful consideration, including a review of my recommendation, the President has concluded that given a number of factors, including a documented history of discrimination, classifications based on sexual orientation should be subject to a more heightened standard of scrutiny.
Attorney General Eric Holder, in an official statement announcing that President Obama has ordered the Department of Justice not to defend the constitutionality of the Defense of Marriage Act’s infamous Section 3 (“the federal government defines marriage as a legal union between one man and one woman”) in court, effective immediately.
